you, the victims of historically oppressive local Public Policies,
will never have the will and fortitude to hold them accountable
for their oppressive Public Policies.  

They think you are disorganized, powerless morons who will passively
continue to be cultivated, fleeced and harvested by the so-called "ruling class"
of this primitive, backward little feudal system of a town.

And so far they have been right in that assumption.

City Council meetings
So what?
For years my mother, Ann Yeager, a widow, patiently endured the chronic abuses imposed upon her
by a series of rental landlords operating a residential rental property next door to her home in Riverside
neighborhood, Columbia, Tennessee.

At times there have been as many as 16 tenants at this one property designed as a single-family dwelling (R-10).

She lived with an unending stream of anti-social(socially disruptive) conduct by the tenants of this rental property.

For example:
Observant tenants could easily determine she went to church at 8:45 am every Sunday morning.
One morning she returned  to find her home had been burglarized on a Sunday morning while she was in church.

All three(3) buildings on the property were burglarized in turn.

Her cat was mauled by an uncontrolled dog owned by a tenant.

...and so on...one minor or major insult after another;
and they never stopped...ever...
still haven't.

She endured these abuses.  
She was "long-suffering."
I am not.
In 2007 I began a systematic survey of City Procedures to deal with the problem of residential rental property
abuses in Columbia, Tennessee.

I methodically followed each step in sequence as I was directed by a series of City Staff and elected officials.

I guess I'm kind of slow...but after a couple of years I finally figured out our City Officials and Public Servants had no
intention of addressing this issue...other than to misdirect me to another red herring(bogus) procedure...and from that
misdirection to another and so on.

Let me repeat that:

I know what you're thinking:  "That just don't sound right."

So, I stopped futilely seeking relief from this broken and unresponsive system.
I changed my approach.

I changed my approach from that of a victimized citizen putting his trust in local government
to that of social researcher...studying and recording the behavior of City Official Staff, Senior Executive Staff and
Elected Officials...all of whom were and are by definition, Public Servants.

I gave her a "sound bite" answer that this display was an exercise in Civil Disobedience.

You know...like Mahatma Gandhi's Walk to the Sea or the Nashville Student Movement
Nashville Sit-ins of the 60's

I explained this display was a work of Public Art designed to bring attention to the
disgraceful Public Policies imposed upon our Riverside neighborhood
and the community-at-large by
Columbia City Council's committed and knowing
acquiescence to Societal Degradation and Reckless Endangerment routinely imposed
upon our community by negligent rental property managers.

This answer did not satisfy.

She said that she did not see this display as "Civil Disobedience."
She saw this display as "trashiness."

Further she explained that she was "tired of looking at it"
every time she drove down Riverside Drive.

"Then report it to the City," I suggested.

She said that she
had reported my trashy property to the City;
further she had also reported the trashy property next door.

"How's that going with the property next door?" I asked her.

"We're still waiting to see on that," she replied.

In 2011 We, The Governed, made a series of six(6)
Public Service Announcements(PSAs)  in six(6)
City Council Meetings in Columbia, Tennessee.

These PSAs treated the subject of City of Columbia
acquiescent Public Policies in which the interests of
35,000 citizens of Columbia have been set aside
in order to serve the interests of the owners of a few
local Commercial Property Businesses.

The links immediately below are copies or treatments
of the addresses which were delivered.

All items in all of these addresses were summarily
dismissed by the 2011 City Council.

Mayor Dean Dickey characterizes our approach
to Social Change as "personal attacks" on
City Attorney Tim Tisher.

Personal Attacks

"This Isn't really news."

The Columbia Daily Herald at one time was a
hometown newspaper in the truest sense of the
word.

Now this publication is owned and operated by a
media corporation 1776 miles from Columbia by
some pencil-necked accountants in Las Vegas,
Nevada.

The Columbia Daily Herald used to have a
newspaper editor who had a sense of Social
Responsibility to report truth to the immediate
community;

Now this sense of editorial responsibility is divided
by loyalty to a ledger 1776 miles away in Las Vegas,
Nevada.

Our current
Daily Herald editor, Chris Fletcher,
as a promising young student at Stephen F. Austin
State University in Nacogdoches, Texas, at one time
had aspirations of becoming a journalist.

Now Fletcher has become more of an ad salesman
for a nickel and dime ragsheet pandering to local
advertisers for a few crumbs to maybe keep this
ragsheet above water a year or two longer before
the inevitable Death of Print.
The Columbia Daily Herald used to have
investigative reporters with noses for news.

Now this nose for news has been replaced by
another sense... a sense of rational self-interest;
a sense of not making waves, of not rocking the
boat and most importantly not offending anyone
who might be a potential advertiser.

Investigative journalism is all well and good;
but if you,
Mr. Reporter Guy, don't have a job with
the Daily Herald you may not be writing anywhere...
unless you start your own blog.

So, The Daily Herald will do to kill a little time; get a
little experience; write a few fluff articles about our
local architecture and our Historical Society.

And then, step on off this moss-covered stone to
the next gig where maybe you'll get to do what you
went into journalism to do.  Write news.

But while you're here remember your place.

  • You are not here to clarify obscurity.
  • You are not here to expose Betrayals of
    Public Trust by local officials.
  • You are not here to reveal blatant
    mismanagement of Public coffers.
  • You are not here to enlighten the reader to
    institutionalised Ineptitude so accepted
    and so commonplace that your Daily Herald
    Editor, the same one who at one time had
    aspirations to become a journalist, says to
    you with a straight face:
            "This isn't really news."

You are here to fill in a few spaces between
grocery store coupons and discount shoe store
ads.

And fill these spaces with innocuous prose and
inoffensive drivel for as long as you can stand it..

Personal Attacks
is new feature of The Seamier Side.

This column is a tribute to City of Columbia Mayor Dean Dickey's
characterization of my legitimate allegations or inquiries about:
• recurring
Breaches of Professional Ethics;
intentional obfuscation of State Laws and local codes
• official
mismanagement of legal proceedings involving City of Columbia City Court;
• official mismanagement of legal proceedings involving Board of Zoning Appeals
• et al

Our Mayor characterizes my allegations as
"personal attacks" upon City of Columbia's
$204,000 @ year part-time City Attorney,Tim Tisher,
of Tisher & Wolaver, 809 S. Main St, Columbia, tn.

(This
$204,000 @ year figure was City of Columbia's 2012 contract figure to pay this City Attorney Tisher.)

The Mayor does not know what these allegations are.

I know that he doesn't know.
The reason I know that he doesn't know is because I've never told him what they are.
The reason I have never told him what they are is because he
refuses to "hear" what they are.

But whether he knows what they are or not;
he has made his ruling whatever they may be.

In a
DEC 2012 meeting, Mayor Dickey, in an uncharacteristic display of decisiveness
declared in front of me and interim
City Manager Jennifer Moody, that he
"...won't hear it."

"It"
in this case meaning the above allegations
and inquiries about the
City Attorney's conduct
in regard to City legal proceedings in which he was,
by definition, the
"direct supervisor."

I asked, "What do you mean you won't 'hear it?'"

Mayor Dicke
y explained that he would "not hear it" in a City Council meeting;
that he would call me "out of order" and stop me from talking
if I brought it up again.                                     

A City Council meeting was where I first brought it up.

The Mayor had also
"not heard it" in a City Council Study Session where he
told me to
"...just sit down and take your seat" when I tried to speak at this
City "Kangaroo Kourt" session in which the renewal of City Attorney Tisher's $200,000 plus
a year contract was being discussed.

So, he won't "hear it" at a Council meeting;
and he won't "hear it" at a Council Study Session.
Where will he "hear it?"

At the DEC 2012 meeting I handed him a copy I had prepared of some preliminary questions.
He said he would not answer any of these as we sat there.
And he has yet to respond since Dec 2012.

In a
Council Study Session, the Mayor also would "not hear" what Councilwoman Debbie Matthews had to say about
this contract renegotiation and proposed evaluation of City Attorney Tisher's performance as City Attorney.

Cutting her off, Mayor Dickey waved his arm around and over his head in the direction of Councilwoman Matthews
as he held a piece of paper, presumably a copy of a page from the
City Charter,
as he barked at her

"There's nothing in the City Charter about [evaluating the City Attorney.]  
Take ten minutes and read it."

I was embarrassed for the man.

Tisher explained to the council members in defense of his $200 grand a year retainer:

"I don't do it all by myself.
Susie spends 60% of her time on City business."

I don't know who Suzie is.

But I'm willing to bet she don't git 60% of that $200 grand.

My suggestion would be for the City to
hire Suzie to do the Administrative Legal research for the City
at the same amount Tisher and Wolaver pay her to do all the grunt work.

And then
hire a new City Attorney at the normal rate of about $50,000 a year
that cities the size of Columbia usually pay a City Attorney.

Then find a space at City Hall to give both of them an office
and save the
$6,500 @ month ($78,000 @ year)
the City is forking over to the private law firm of Tisher and Wolaver
to pay for their support staff, office space and utilities.

Let me repeat that:
The
City of Columbia pays this private law firm $6,500 @ month for support staff and overhead.
That's $78,000 @ year your City Council pays to a private law firm for staff, rent and utilities.

We at The Governed think this is an unconscionable scam perpetrated upon the People of Columbia.
Who came up with this idea that the City pays for the City Attorney's rent, utilities and hired help?
And who came up with this absurd figure of $78,000 @ year payoff?

That's not counting the 2012 contract $10,500 @ month (126,000 @ year)
Tisher takes from the City for his personal compensation.

Total $204,000 @ year
for services which are apparently not accounted for in Public Record
nor anywhere else that we,The Governed, can find.

It's a secret shared on a "need to know" basis;
and we,
The People, don't "need to know."

Early in 2012 I had emailed the Mayor the same list of inquiries
and had asked him to respond to my inquiries concerning
Tisher's alleged improprieties in handling at least four(4) local legal proceedings
for which he was "direct supervisor" according to the same City Charter document
Mayor Dickey unceremoniously was waving at Councilwoman Matthews at that
earlier Study Session.

Late in 2012 I handed Dickey the same written list (at that Dec 2012 meeting)
of my legitimate inquiries into what I consider to have been
professional misconduct or at least professional ineptitude
and/or professional improprieties
on the part of City Attorney Tisher;
and a different form of misconduct and/or ineptitude on the part of
Mayor Dickey as a Public Servant of the City of Columbia.

That was in December 2012.

It has been over a year and I have not heard from anyone
about anything regarding these matters.

That's nothin'...from nobody.

I think I have provided appropriate time for response.
Altogether two(2) years have passed since I first sent this list to City Manager Boyer.
Boyer wrote back the following:
"I do not intend to respond."

I don't know; but I think none of them intend to respond.

And even if they did, at this point I no longer consider any venue of investigation nor inquiry
convened by any Columbia City Council, City Board or City Executives in regard
to this inquiry to be anything other than another self-vindicating "Kangaroo Kourt."

I have seen this "Kangeroo Kourt" model multiple times in my research into our local government.

And I know from direct experience
(The reason I know is I've already asked..... multiple times)
that our local newspaper, The Daily Herald, is not
going to publish anything about these alleged improprieties of the City Attorney; and, now,
those of Mayor Dickey's in his clumsy attempts to sweep these allegations aside with his "bully pulpit."

I don't think his pulpit is all that bully.

And I don't tolerate being bullied from a pulpit nor anywhere else
by smug city officials and complacent self-serving city executives.

I wasn't making "personal attacks."
But I am now.

I think that's the only thing that will work on these
complacent, smug, self-satisfied, provincial, redneck imbeciles.

If you want to see what I do when I make "personal attacks"
(as Mayor Dickey characterizes my legitimate inquiries)
then continue to follow this column.

You're not gonna find this in the Daily Herald
nor City Council minutes nor anywhere else in this city.

We'll go through the whole gang...
one at a time...
one complacent, unresponsive, duplicitous public servant at a time.

And there won't be a freaking thing you can do about it...
except continue to plant your complacent, unresponsive, duplicitous heads
into the sand at your feet.

I know what it looks like it.
This article looks like an indictment of Property Manager Poling.
It's not.

Mr. Poling does nothing without the consent of City Hall.
And everything he does seems to be okay with City Management.

In Columbia the number of Police Calls to the same residences
over and over again is irrelevant to any of our zoning codes.

So he's in the clear.

I admire Jim Poling.
He does things his way.
He has a Strength of Will not found among our Civic Leaders.
He's a hero.

He should vigorously challenge any attempts by
City Officials to coerce him into complying with City Codes.

A man's property is sovereign.
It's what America is built upon...sovereignty of private property.

No; this article is not an indictment of Property Manager Poling.

For years my mother, Ann Yeager, a widow, patiently endured the chronic abuses imposed upon her
by a series of rental landlords operating a residential rental property next door to her home in Riverside
neighborhood, Columbia, Tennessee.

At times there have been as many as 16 tenants at this one property designed as a single-family dwelling (R-10).

She lived with an unending stream of anti-social(socially disruptive) conduct by the tenants of this rental property.

For example:
Observant tenants could easily determine she went to church at 8:45 am every Sunday morning.
One morning she returned  to find her home had been burglarized on a Sunday morning while she was in church.

All three(3) buildings on the property were burglarized in turn.

Her cat was mauled by an uncontrolled dog owned by a tenant.

...and so on...one minor or major insult after another;
and they never stopped...ever...
still haven't.

She endured these abuses.  
She was "long-suffering."
I am not.

12JUN14 Columbia City Council voted overwhelmingly to renew the legal services contract
with
City Attorney Tim Tisher of Tisher and Wolaver,  809 South Main Street.

A discussion was held by Council regarding the
costs and services
associated with this item.

Council Member Debbie Matthews advised she would be voting no.

She spoke about other cities and the amount that they are paying for a
full-time attorney compared to what the City is paying for a part-time attorney.

The rest of Council voiced their support for this item.

Tisher will receive $16,250 a month for legal services.

That figure includes a monthly retainer of $10,500 for the next two(2) years.
That's $126,000 @ year.

Further his private law firm, Tisher and Wolaver,
will receive monthly
$5,750 for "overhead and staff."
That's another $69,000 @ year for rent, utilities, copy paper, Lexis-Nexis and staff.

That's a total $195,000 @ year for legal services, overhead and staff.

I should have said this sooner.

When I speak of
City Council Complacency
I'm speaking of City Council as a collective,
dysfunctional organism.

Mark King does not fit in with this torpid bunch.

As an individual councilman, Mark King has been an
effective advocate for our Riverside residential
neighborhood.

The operative word there is "effective."

Making any kind of a stand at all, on anything, sets him
uniquely apart from his colleagues on City Council.

The New Guy stood up for his
constituents...at least the ones in Riverside.

I will show you some changes in Riverside as a result
of Councilman King's persistence.

Who is Tony Massey?
In the South at least, City Managers are like gypsies.
No offense intended to our Gypsies.

They move from town to town.

Our new City Manager, Tony Massey, is of that breed.
With a UT degree in Public Administration his career
in Government has enabled him to leave his stamp on
a least seven(7) cities in three(3) states.

And now we have him.
Columbia is Massey's hometown.  And we are fortunate to have him.
He already knows how we do things around here.

Tony, if you were looking for a quiet place to ride out the rest of your career in
uncritical obscurity and bland mediocrity then you have come to the right place.

"not permitted" to impose remedial sanctions upon local slum-landlords who
consistently degrade, devalue and endanger our residential neighborhoods
within the city.

Local City Officials tell us that Tennessee State Law "forbids" local
government to legislate local ordinances to regulate slum-landlord abuses in
Columbia Tennessee.

Ms. Butt, is it in fact forbidden by Tennessee State Law for our local officials to
create local legislation to regulate incorrigible slum-landlords?
